Typical internet harda$$ landlords. While you would probably win any case againstthe landlord, it's not worth it. He's turned off to you and will be a jerk to you for however long you rent his place. You are definitely entitled to the month you have paid for, yes. I'd just find a new place. And I would quit smoking, that stuff is just nasty and costing you way too much. You could afford a much nicer place if you used all of your smoking money on rent.

How bout save that money and buy your OWN place. Best time to buy is now. The prices are lowest ever and loans are very low interest rates.

Why do you assume it's an attitude issue (hardass) with "internet LLs"? Why can't the LLs requirement for on-time payments be legitimately tied to his obligations on the property, such as mortgage, taxes & insurance, with related deadlines for his payment of these items. A shortfall on an anticipated rent payment (there's a reason the rent is due on a certain date) may adversely affect his ability to make good his obligations, effectively letting the tenant's problems become the LLs problems -- something that should never happen. I require tenants pay rent on the 1st because I have to wait for their personal checks to clear before I can use the income to meet my obligations. That means the funds are available around the 5th-7th. A late payment pushes that availablity date back further. If a tenant pays late, their late fee compensates me for advancing funds from other income to the obligations on that rental, or for fees/fines assessed by the creditors. This is why it's important to me that my tenants have the gumption and ability to save money so if they have a problem with their income, they can dip into savings and pay on time, rather than pass along to me the problem.

If you need that money that badly that it's a financial burden on you if they don't pay on time, you may want to reconsider why you're renting out a place to begin with. I rent out my old townhome and an additional 4 places I bought. I didn't even consider this until I knew I had 6 months cushion to pay expenses related to each property I was renting. I learned quick that renters are unpredictable and that's just the nature of the beast. I won't get my rent on time every month of the year, I won't have every tenant fulfill the lease, I won't have every tenant leave my house in pristine condition, I won't have a tenant within 2 weeks after a previous tenant moves out. It's just the way it is. Ideally I wouldn't have to have that cushion, but it's a much better option than worrying if Johnny is going to pay is rent by the 1st every month.

Agreed, a LL needs to be properly funded. BUT that doesn't relieve the tenant of his legal obligation to pay rent on time and in full. Business is business. I save my favors for my friends.
