HI,

I have a tenant who move out at month 9 but the lease is 12 month. He do give me 30 days notice and I acknoweldged. But there is 2 weeks gap between the new tenant moving in. I initially told tenant that I am ok to cover 1 week vacant. Now I am in the process of refund his security deposit. Is it ok that I deduct 1 week's rent saying not occupied by new tenant but still in his leave term?

Your tenant broke your lease and your are entitled to keep the SD funds equal to the rent money you lost between the old and new tenant, plus you can recoop any advterising or marketing costs you incurred. Do not return any money or send the SD reconciliation letter until after you have thoroughly inspected the house for damages, and the new tenant has actually moved in and paid you. But make sure to send the SD letter within your state's alloted timeframe, usually 30 days. If the new tenant has not moved in yet or paid you all the move in funds by the 30 days, explain in the SD letter that the refund amount, if any, will depend upon the new tenants successful move in and payment of funds.

Do not forget to charge off all cleaning, painting, repairs and damages too.

Yes it is ok to deduct the 1 week rent. And you are being generous by not charging for 2 weeks.

Make sure that you send him an itemized statement before 21 days.

In Washington state we only have 14 days to itemize SD and refund funds, so check what the time is for your state.
