Removal of tenant property due to basement flood by anonymous (CO) on June 10, 2012 @19:59

                              
My rental basement was flooded with water, hail, debris during storm in Colorado Springs. I am sending a crew to clean up. My tenant has renters insurance. His agent says he may not remove items until adjuster comes. Is this true?
Also am I required to pay for accommodations for tenant because he has no heat source or hot water until repairs are complete?

The agent is correct.

You only have to prorate the rent for the time that the rental is uninhabitable.

Is this a legal apartment that has no conflicts with the city codes?

I have no idea how this would work but it seems you should be able to mitigate your damages by getting the basement emptied, cleaned & dried. I'd check with my agent - what if the tenant's adjuster doesn't show up for weeks?
