Unpaid deposit w/ signed lease

My multi-unit home is in foreclosure. I was advised to get a tenant in the apartment to help my case. A long time friend relocating from Vegas wanted the apartment starting July 1st. I needed the paperwork for court so we both signed the lease and he faxed it back to me. Meanwhile he gets arrested on a bench warrant in Vegas but the case was thrown out. He refuses to respond to me about the apartment for coming to his son's defense when he was trashing him. Since he hasn't responded or put money down am I obligated to keep this option open for him?

Probably not, because there was no money exchanged, only a promise to pay, so the fiduciary duty is not there, but check with an attorney just in case. Maybe others here will know more than I do.
Was the lease signed when you faxed it to him for HIS signature? If so, big mistake because tenants can be very creative, and hey,you've already signed the lease. See what I mean?
