Probably not, because there was no money exchanged, only a promise to pay, so the fiduciary duty is not there, but check with an attorney just in case. Maybe others here will know more than I do.

Was the lease signed when you faxed it to him for HIS signature? If so, big mistake because tenants can be very creative, and hey,you've already signed the lease. See what I mean?

Yes, I did. I thought about that mistake after the fact but it had to be signed for proof in court that I did have a tenant. But I completely see what you mean.
