Can I vote this for most vague post ever? What legal action are you wanting to take? Where do you live? Different laws govern different states.

You need to start legal process immediately when the lease has been breached by the tenant. That means posting the pay/quit or cure/quit, waiting the specified number of days IAW your state law and then proceeding to evict. If you wait longer, you are just going to be out more time and money. I've been at this 20 years and you can take my word for it, as a LL no good deed goes unpunished.
