Did I read this right????

Our tenants gave us notice 60 days before lease end that they would not be renewing....lease was up May 31. They were actually moved out about the middle of May....On May 27 they were in the unit for about 8 hours, cleaning or so we assumed. On May 31, I had to call them at 5 p.m. to ask when they were bringing the keys....I was informed they were on their way to the apt. to pick up a few cleaning things and would return them in "just a little while".....well, long story short, I had to keep calling and trying to find them and didn't get the keys until June 3 at about 7 p.m. I read the PA LL/tenant law--AGAIN--and from what I see, they technically owe me rent for the month of June.....Is this correct??? I only ask because we were actually not able to re-rent the apartment until June 10th because they not only did NOT do any cleaning, but left a path of destruction at some point....we already have the contractor/cleaners itemized list of what was done and it is WELL over the amount of their security deposit-----as they are both employed in very good jobs we will be taking them to small claims if they refuse to pay, and I just want to be certain about the extra month--let me rephrase, at least the days we could not rent as we DID find tenants, just couldn't let them move in till the unit was finished---added on if we can.

You can prorate the days until a new tenant moved in. It is not legal to collect the full month if you rented the place to someone else during that same month. Take all cleaning, repairs and damages. Get your settlement statement out within the limits of your state requirement. Make it understood that you want the negative balance payable within 5 days. If it is not paid, file in court. Do not allow the tenants to stall you. They have already done that enough.

do not file small claims. file a Landlord/Tenant complaint. since they both have good jobs, you will be able to garnish wages on a Landlord judgment.
