I think the thing to do is tell her you would love to have her as a tenant however you cannot promise her the property until the old tenant has vacated. :( In my opinion this is the sound business decision to make.

I advertised early. Had almost two handfuls of tenants who were interested in the property early and wanting a lease for July 1. Well in calling back the people I spoke to a month ago to see if they are still interested I find half of them have found a place. :( I still have a few, so that is hopeful. Also what it shows me is that I am priced right or still under given the response and that is good information. I refused to show the property because I just didn't want anymore contact with the tenant unless it was necessary. Also a good choice.

If you do try to negotiate with this person I would definatly stand firm and state that you have no control what your current tenant will do. You do not want to have a lease with two people as it will create a pickle. It would be bad business for you and they would end up homless.

Stand firm with what you know you can promise. Also take this as a good sign that this person who is qualified really wants your place! Tell her the best you can do is set a date to sign the lease on the 21st and that if something changes you will contact her.

Also you do realize you are setting grounds on who is in charge. Someone who is that pushy is going to be way way more trouble. I have learned this and am looking at this character in possible new tenants. She is expecting you to promise something you can't. What about when she wants something that she thinks you can say yes to? I agree maybe this one is not right and its a good idea to let her slip away.

Seriously look at the stress she is already causing you!

Thanks everyone for the responses...do appreciate it tons..

I decided for now, to write her an email with the update..here is what I sent her:

Hi [future tenants name]"

How are you? Hope you're enjoying this great weather!

I have great news - I did speak to my current tenant and she has confirmed that she will be selling some furniture in the apartment, so she has promised to email me a detailed list of what she is selling, prices, etc.

I will email that over to you when I receive it.

She also confirmed that she has already placed a deposit down for her new apartment, the only concern is that the place she is moving to is an apartment where the tenants living there are closing on a house ON July 15th. While she will have moved out by her end lease date of July 31st, she does NOT know whether she can get her stuff out before that day. She is eager to move in by July 25th, if its possible, but it is all dependent on whether the people who live in her future apartment can close in mid July. If they close later in the month, she can't move in until they move out..

So that is where we are now - I can promise a full refund of the $ ___deposit you pay from now until we sign the lease (on or about the week of July 22-29th). I am sure I will know more once she lets me know if this closing is going forward on 7/15. Unfortunately, I can't promise a July
July 30th date because its dependent on when her future apt becomes vacant as well.

I want to not lose this tenant, it took me 2 months to find her. She is more qualified than my CURRENT tenant by leaps and bounds (career in law enforcement, 800 FICO, great references, etc). I am just concerned she will bail out because the unit wont be ready by July 31st. She doesnt care so much about cleaning, etc. I told her I would be happy to do all that work the first week of August anyway (and she has no problem with it either).

I am just hoping for the best...

That was exactly my point, Anna did a much better explanation! lol.

The credit score is great, however, you can also blame the 2 months of not finding tenants to the fact that maybe interested people were not looking so far ahead {although it's always good to find a new place in 2 months, not all of us do it, so, that could also be a factor}
