Has anyone ever had any problems with using the LPA Lease, specifically in MA?

We just had a tenant (after he signed it, of course - not that it would make a difference) squawk about it, saying he's "never seen a lease like that." And he's "pretty sure" there's a lot in there that's not legal. He's demanding to know where the lease came from.

We told him we're not changing the lease, that it's a standard form MA lease and we're sure it's legal and valid. I'm not worried about it, just curious if anyone has ever used it and had any problems with it.

I wonder what "parts" he is concerned over. This will give you great insight for your relationship with him. Whatever it is he is pretty sure is not legal you can bet it is because he intends on or feels he has the right to violate that clause.

Send the tenant a "crusher" letter advising him to take the lease to his attorney and let the attorney explain it to him.

I've had lots of tenants over the years who'd had problems with the lease.
My favorite was the tenant's lawyer who called to try to negotiate a better position for his clients.

He was extremely uncomfortable with the following:

My responses on these topics were:
Late fees:
Me: Do you really think your clients will have a problem paying the rent on time?
Lawyer: No, of course not. Their both renouned surgeons.
Me: Then this really isn't an issue, is it?
Lawyer: No, I guess not, but a late fee is insulting.

Grounds:
Lawyer: My client will agree to grounds maintenance, but I'm not happy about them committing to it in the lease.
Me: You're an attorney. So what's so bad about your clients having their agreements in writing? Do I have to worry that they won't keep their word?


Maintenance: Same BS as above.

He also demanded to know what kind of lease it was. I told him it was our own management company lease. He said he'd never seen one like it and that if he represented any landlords, he would use it!!!

The doctors rented from me for 2 years and stuck to the lease, took their $10. early payment discount every month and were among some of the best tenants ever.

That was around 20 years ago!

It's gonna be a long year. He just called to complain that his bed won't fit up the stairs. Don't know why he thinks this is our problem.
