I'm not breaking the lease, though. That's the deal. It's being fulfilled according to its provisions clearly spelled out in the lease.
I understand a security deposit can be used for unpaid rent, but all rent and appropriate fees will be paid. Now, a month after I give him notice, he brings this up. As if the $3,000+ in the breaklease fee wasn't enough. How is this not just being greedy at this point?
Unless he's a complete idiot about this and it takes him over 3 full months to rent this place out, he's profiting off of this move. That alone doesn't sit well with me. I totally get making sure he doesn't suffer any financial loss due to my move and even giving him payment for his trouble in having to re-rent the unit. How does this not sound like he's taking advantage of the situation? Next thing he won't want to return a cent of the security deposit and claim it's because I left early. Might as well let him have another $1,000 because my work transferred me!

Would the law see it like that? I don't think so. I can find dozens of cases with a simple internet search showing that a landlord can't keep a security deposit if the lease is broken in accordance with the provisions in the lease. It can only be used for unpaid rent and damages caused by the tenant.
