Bunny *M*A*G*I*C* - I don't have a clause in the lease that states that anything affixed to the property becomes the property of the owner.

This is the second time I rented to college students. The first were a couple going for their Masters. The Masters student's took paid on time and care great care of the property. The tenants I have now, two are undergrads and the other tenant is the boyfriend of one of them. All three of them are on the lease as "jointly and severally". I took a ton of pics before they moved in and have documented every conversation I had with them and maintenance reuqests. Also, the parents of one of the students did a walk through when they moved in. We threatened them with eviction in Jan. The lease violation stopped immediately. They know that my wife & I are unhappy with them. I wouldn't live some place I am not wanted.

At first I was worried because I have read stories about tenants claiming hardhsip and unable to move some place else. I checked Craiglist and there a ton of apts in my area or the surrounding area that is either cheaper than what they're paying or is much better looking than my apartment. They better not use that tatic. Because each of their parent's make six figures, parents pay for ALL the utilities and their education. Boyfriend just got a job this month after being unemployed for 10 months. I would like to see them try to convince a judge that they are claiming hardship and can't move.

Do they know that you are not going to renew the lease yet? You should let them know sooner rather than later.....don't know what the state law is in MA.

Big maturity difference between grad and undergrads.

I wouldn't fight over the AC units personally if they bought them.

I grew up in MA so I know.....the climate used to be such that you only really needed AC a week or so in the summer. When I moved south my car didn't have one either. In GA I can't imagine being without.

    I have calmed down and I am not going to quibble about their AC's.

    MA state law requires a 60 day notice. However, in my lease there is a clause that gives a 90 day notice. The timeframe states June 1st - June 30th for notification of renewal. Lease end date Aug 31st. Which at that time a new lease would be signed at my leasing agent's office before June 30th. My lease is not a automatic renewal. They were sent the non-renewal letter via certified mail by my lawyer for delivery on June 1st that the lease wasn't going to be renewed. In Jan, my lawyer sent them a letter threating with eviction of a lease violation and they signed for it without any problems. Also, I would think if they really wanted to renew the lease they would have told us by now or their parents would have notified us by now since the parents pay the rent and utilities. The parents have a copy of the lease also. In April, one of the tenants asked what will happen with the oil if it isn't used. Her oil bill for March was very high. My wife told her that when they vacate the premises in Aug, any overage of oil they will be reimbursed. Which is clearly stated in the lease. They asked a similar question a week later. Reiterate what my wife said again about them vacating the premises in Aug. Oil is expensive and they & their parents signed a lease that they are repsonsible for heating the apt. After my wife told them that they have become extremely quiet.

    I have seen all three tenants almost everyday since June 1st and they haven't said a word to me about the lease. But I can't go on what they are thinking. I covered my butt in regards to notifiying them in the time frame that I was suppose to per the lease agreement.
