I recently was called by my tenant that they had a bat in the house. I immediately called an exterminator who came out within 18 hrs of my notice that there was a problem. The tenants apparently knew of the bat in the house for at least 9 days prior to calling me. When they captured the bat and called animal control to remove it,they then notified me. At that time they elected to undergo rabies vaccine. Now they are telling me they cannot enter the home for 14 days (but they went in with a mask on to get their personal items). The exterminator found a bat colony in the eave of the home but due to bats being protected, they cannot remove them until Aug 1. Due to the C/O it was agreed by the tenants and myself that the attic was off limits and a lock was put on the attic door. Upon entering the house with the exterminator, the attic lock was ripped out - hanging by one screw (still locked). It was determined that the bat most likely got into the attic by a crawl space door that was also opened and most likely got into the living space through the attic door which was not shut tightly and a cabinet was placed in front of it to keep it closed. My tenants do not want to remain in the house - the least is up 8/1, which I have agreed to. Can I be sued for the bat being in the living space of the house?

Take pictures of the damaged lock then you have proof that it was the Ts fault.

Wait, was someone bitten by the bat? Why would you go through those painful rabies shots in the belly if you hadn't been bitten?

You are using too many pronouns to make your story understandable. Who caught the bat? Who had rabies shots?

No,they can't sue you. Rodents are a natural occurrence. You did not go to their house and place a bat in it. You did the appropriate thing which was to find an exterminator. That is all you can do. You may want to negotiate a lodging expense based on the fact they cannot return to the home for two weeks.

I had a problem with rats a few years ago in one of my Apt. buildings. I hired an exterminator immediately. All of the tenants were irate with me and thought they could sue me. My attorney did not agree and neither did theirs. I did not attract the rats to the building nor did I plant them there.
