I rented to a couple that seemed good but after one month they said they are withholding rent for mold. The basement had leaked and it took me 2 times to fix it. They filed the withholding while I was working on it. It is fixed (so far) and I had a mold test that turned out neg. I emailed them the report and demanding my money and have heard nothing. I think this is a scam and now they have a sc suit against them I am sure from there previous ll. Can I evict them for lying on the app or withholding rent or what. I think this is MO for them and the guy turns out has some anger issues. I just want them out this is only month 2. HELP

First, go get a sample of the mold and get a test kit from Lowes or where ever. Then immediately post a pay or quit notice followed immediately by an eviction notice.

Why didn't this show up when you did your application checks? Didn't you follow up on previous LLs, credit checks, criminal and court checks?

To me this is a no brainer: start eviction proceedings. They aren't paying rent, and that's all the reason you need.
