My tenant from first floor is complaining about my second floor tenant.
As an example : This second floor tenant came back home last night about 1 :00am, open the TV on his bedroom - which is located just on top my first floor tenants' bedroom - then let the TV all night long.

I talked to the second floor tenant last month about this same issue, and he apologized, and promised to be careful about it.

I am very concern about this nuisance, what should I do ?
The noise issue is part of the lease contract.

Send them a noise violation letter. Other than that it's not really your business. They can call the cops it they want. Don't renew the person upstairs.

What happened is your upstairs tenant came home drunk, turned the TV and fell asleep. This will happen again. It is reasonable for your downstairs tenant to expect the "quiet enjoyment" of his apartment...especially between 1:00am and daylight. You will need to decide which tenant you value the most because the upstairs tenant will run off every good downstairs tenant you get.

Enforce your lease. You don't have to play noise cop but it's a good idea to respond to both the complaining tenant and the accused tenant in writing so you can CYA in case this ever gets out of hand.

Thank you all for your answer, I think I have to send him a note, he is a very good tenant and the one downstair is veru good also, I would like to keep them both.

If the tenants froms the second floor decide to leave, can we consider the leaving as a breach of lease ? He has still 7 monthss before the end of his lease.
