What happened is your upstairs tenant came home drunk, turned the TV and fell asleep. This will happen again. It is reasonable for your downstairs tenant to expect the "quiet enjoyment" of his apartment...especially between 1:00am and daylight. You will need to decide which tenant you value the most because the upstairs tenant will run off every good downstairs tenant you get.
