You can not set the move in date of the new tenant so far ahead and make the old tenants responsible for the vacancy you created by it. Do whatever you feel good about.

    Keep in mind that your tenants did not have a lease that clearly conveyed their responsibility for notice or your requirement for it.

    The date was already set before they told us last minute that they were leaving 1month early

      Did you have a lease in place that provided a penalty for an early departure? You have to accept a measure of responsibility for the inconvience of the departure as you rented for three years without a lease in place.

You cannot collect rent from two people at the same time, so you must give half back.

    Why not?

    Please cite your legal precedence as it affects the OPs or any other state....

    Please don't cite a a responsibility to mitigate damages, they are not the same....
