UPDATE: Non-Renewal Notice

Tenants did receive letter regarding non-renewal they just didn't send the card back. PITA tenant is under the assumption that she doesn't have to pay for Aug's rent. Lease ends Aug 31st. Seriously?! She said that she doesn't understand the letter. The letter clearly states that she needs to vacate the premises on Aug 31st. I told her that she & her roommate are responsible for July and Aug rent. She saw an apt that she likes. But the new landlord wants her to move in on Aug 1st. Not my problem you owe me July and Aug. She then asks me what time on the 31st does she need to be out. Does she have to sleep at someone's house the 31st because she will have no place for Sept 1st. Do I have a new tenant for Sept 1st? Seriously?! I didn't answer any of those questions. She wanted to sit down and talk about it. No! I told her again you owe me for July and Aug and that this is my last conversation regarding this issue. Any other questions please contact my lawyer and wished her good luck. It became silent on her end of the phone.
So you want to use Aug's rent that is due to me for your new apt. No way!
It's funny the other roommate seems to have no problem with understanding the lease or the non-renewal letter. Not once has the other roommate asked about the letter. In fact, not once have I had any problems with the other tenant. PITA doesn't understand that she signed a lease that is "jointly & severally" and her actions affect everyone on the lease. If I don't receive rent for Aug from PITA, I will be in court to retrieve it from everyone named on the lease, including the co-signers. In MA you can't use the security deposit for rent. If you sign a contract you uphold it to the end.

The next step will be starting an eviction on August 1st for non payment of rent? Unfortunatly for the roomate I think that means that you name them both? Then the roomate will either pay up or else?
