(sorry for Double post, it took out my name. Wanted to be sure it was known that I posted this or it could be confusing)

Ok, I see even though I have them agreeing in a text to not have the animals in the house, that is of no value, even though they did it behind my back.

Since a text agreement isn't acceptible, then since they gave me there notice of moving out via text ( just said they were not renewing the lease), and not written 30 day notice as stated in the lease, then I can get them for any portion of rent for the month after they leave that I don't have new tenants? They made it hard for me to show the house. One time the tenant refused to get out of bed at 11am on a Saturday, stating I had no right to show the house while they still lived there, even after they agreed to the time.

Based on the tone of the replies, I get the impression of frustration of those replying. Excuse me for my lack of understanding, I am not a professional landlord. I am only renting out my 1st home after I bought a new one. I hope you can understand, knowledge has to begin somewhere, so I can here for help.

You are trying too hard to get money from these tenants. This will not play out well in court if you go there. The best thing you can do is deduct your expenses from the deposit and sue them for the remainder. Right now you need to concentrate on getting your tenants down the road. It is turning out badly because you handled the whole thing badly.

    They are out. Actually you are totally wrong. I already have enough damages for the deposit. The got oil based paint on my siding, the new carpet is ruined, they destroyed my new screen door that was put on 5 months after they moved in. They put holes in my laminated flooring for a door mat, took all the light bulbs, oh and they admitted to having gotten a matress from family that had bed bugs. Plus they still haven't paid $200 of the rent. To be honest, I want to know what all I am legally intitled to to put in the note as to why they aren't getting a security deposit. I am not one who likes to go to court, but if they persue it, I want them to know how much they could be out. Everything I am willing to chalk up as a loss in order to get them to just stop harrassing me about the deposit.
