I agree with the other posters. You should contact an attorney before you face a discrimination suit.

On a separate note: Did you ever think about moving upstairs? Most LL's I know, including myself live on the 2nd floor of a two family home.

I have considered it, as it would bring in much more income, but honestly the downstairs is much nicer and has more amenities--basement, large porch, garden. More recently, I have considered reclaiming the 2nd floor as a work/guest space for myself, and renting out only my 3rd floor apartment.
