You can not just drop it and keep the tenant's money. It is too late for that. They still have a suit against you. They want all their money back. You may understand it that your suit is dropped but, ya know, they do not accept it. If you do not show up in court, you will lose by default because that is not the way they want to accept it.

Thank you for your advice, Captain Obvious. I obviously know they have to drop their counter-suit before it's all settled. And guess what? Upon telling them the suit was dropped, they said they were dropping their counter-suit! This was almost certainly the case since they're moving out of state and don't want to go to court. I knew court was the last thing they wanted to do since they'd have to come back after they move.

And who the hell doesn't know if you don't show up in court you will lose by default? Seriously? You should join the FBI, your investigative skills and legal knowledge are outstanding.

    Remember, you are the one who put themselves in such a position as to have the tenants sue you because of your poor lease clause. This could have all been prevented if you knew what you were doing to start with!
