You should probably ask your insurance agent about your liabilities with an illegal apartment. However, you have larger problems. You are not only violating the fire codes but city codes too. Sooner or later your tenant will stop paying rent and report you. The city will fine you, the fire department will fine you and you will have to return all the rent the tenant ever paid.
