My tenant is licensed to sell sandwichs and other food from his mobile vehicle. The trouble is he oftens sets up in front of the SFH he is renting from me. I can not stop him from parking on the street and he is licensed to sell. It is beginning to create a bit of a traffic jam and the neighbors do not like it. How can I put a stop to it?

Many Cities and Counties limit the time a Mobile Food Vehicle can operate from one spot. Also they are limited as to the location they can operate from. Residential areas may be off limit to such a Mobile Food Vehicle.

Some counties here in Georgia prohibit even an Ice Cream truck from parking in the same place for more than ten minutes.

Place a call to your local Health Board or who ever issues permits to check the law and issue a complaint.

Does your City or County permit a commercial truck with advertising on the side to park in a residential area? Many do not, check it out and require the tenant to find parking some where else.

Issue a notice to cure, since you have received complaints from your neighbors. Your tenant should be fitting into the neighborhood without causing conflict with the neighborhood for you as the landlord.

If I'm getting this correctly, your tenant is selling sandwiches outside his home on the street. If there's nothing in the city/county ordinances discouraging it, there's definitely nothing in your lease that can be enforced to stop him from doing business. If it's on the street and not in the driveway, that's a public place that's outside of your realm of jurisdiction of enforcing a lease clause that says no businesses can be run from your home.

What can you do? Man up and talk to him. Say neighbors are expressing concern and ask if there's anything he can do to go somewhere else some days of the week. I'm not sure what else you can do besides not renew him when his lease is up.

New Orleans food trucks can only stop in one place for 30 minutes at a time, and can only visit the same spot once in a 24-hour period. Food trucks can’t sell dishes made from seafood, a big roadblock in a place known for its tasty shrimp, crawfish and Gulf-caught fish. Trucks also can’t set up within 600 feet of a school, cafeteria or restaurant.

The city classifies food trucks as mobile vendors, putting them in the same category as souvenir sellers.

In order to cook on a truck, the city requires a health department inspection and a fire inspection, and trucks must make any needed modifications before they can open.

I suggest taking your complaints to the department that issues the vendor license. Find out the information, pass it on to the neighbors and have them also call in/write in complaints.
