Hi all! I'm back with a warning to all of you landlords. Here's my OP a few weeks back:

"I am breaking a lease early in a MN townhome due to a job transfer. Sucks I know, but my work is paying all the appropriate breaklease fees and such as outlined in the lease.

My question is this. When we were negotiating the lease, we agreed on $50 less per month to do a 2 year lease. There is nothing about this discount in the lease, it was just verbal and the monthly lease price in the lease is what we were paying ($50 less than he had it posted for).

He wants to keep $600 of the security deposit as a re-payment of this discount since I only ended up staying there one year. I'm already paying him (well... my work is paying him) a 2 months rent breaklease penalty. My lease should be considered fulfilled since I am not arguing this fee and doing what is required to end it. I understand I'm the one breaking the lease, but it seems he's tacking on things left and right just because he knows I can charge it to my employer.

Where do I draw the line? It seems a bit much to let him keep the security deposit for a place that will be left spotless and in better condition than when he rented it to us (my wife had nothing to do all summer since she's a teacher and is a clean freak)."

Well, my company's lawyer took this lowlife to court for his fees after they were fed up with what he kept tacking on. He wanted to keep the whole security deposit for this rent decrease and other cleaning fees he couldn't document. They won, got 2x the security deposit back and the landlord had his renter's license suspended for 2 years(required in the city he's renting in). Just goes to show you morons you shouldn't nickel and dime for every little thing.

Not everyone is a moron. There are idjits around, of course, and you got one.

Please don't paint us all with the same brush.

The LL you wrote about gives others a bad name. That LL really should have documented thing and been fair and legal in his expectations.

I remember your post that when other's replied to you, you only came back whining more and more when the poster told you something you didn't agree with and you just wanted a slew of people to agree with you. Some people responding were dumb and condescending. Some presented their opinion in a thoughtful and respectful way even if it wasn't to defend your stance.

When you ask for opinions, you will get some that don't see it your way.

Either way it didn't matter what anyone said on here or even what your or our opinion was because you had a department full of company lawyers calling the shots.

PS: YOU are NOT a LL slayer. You didn't fight anyone or anything. The company you work for did. You had no control over what they decided to do with the LL.

  • What is the likelihood of the corporate attorneys making the security deposit issue a priority?
  • What is the likelihood the small claims court would have an available hearing date open within two weeks?
  • What is the likelihood this post is fraudulent, like the OP himself?

    Sorry that you had this experience but you just blew your credibility by calling all landlords morons. We provide something many people (including yourself) need - a ploace to live.

    How about some class and make an apology to those of us that offer a well maintained dwelling and follow the laws of our states that deserve better than what you have dished up.

    I am glad the Attorneys won your case. I for one thought your LL was completely irrational when you first posted. Like Bunny said not all LL are bad ~ I can tell by the posts the ones I would not want to deal with. We are NOT all made from the same mold. Thank God. We have sold several of our rentals over the years and FYI ~ Some buyers are pre-approved and the sale has closed in less than 2 weeks. Not uncommon.
