Hello all. I posted yesterday about the bashed in garage door but didn't get many specific responses...but thank you to all who did weigh in. Any help and advice is appreciated. Here is a specific question..the picture I took of the garage door was taken 2 days months prior to move in. I took pictures of everything else at move in but forgot to take a pic of the garage door again. As far as I can tell, this tenants ex husband ran into the door. I have a witness who will say he saw the guy trying to bang the dent out and I have pictures of damage now. So..is my before picture a problem bc it was taken two months prior to move in. I also have the move in inspection form saying garage is OK. The lady is also nut job and emailed me saying " this is news to me" and "hiw do i know tou did t do it just to be vindictive". Please oh please - i have that in email but i would love for her to float that hypothesis in court so it is clear how insane she is. Any advice is welcomed. I'm just worried that the pic wasn't from the move in day...

If someone ran into and damaged the garage door, wouldn't you be calling the landlord and rasing hell that someone did it. They seem like it's no big deal to them! Guilty!

The landlord’s photographs with the move-in inspection report signed by the tenant are sufficient evidence to confirm the condition of the garage on the move-in date. The court will not likely ask whether the garage door photograph was taken on the date of move-in or several weeks prior to move-in. The email communication from the tenant indicates that the tenant is being facetious and not serious about the damages.

The landlord should focus the replacement cost of the damaged panels in order to restore the garage door to original condition. The likelihood the court will reward the landlord replacement value of an otherwise functional garage door is highly unlikely.
