My tenants haven't even moved out yet and we have a dispute about who caused some damage to the exterior. Here is my question...i already did the move in inspection checklist form and she signed...when we do the move out inspection and walk around.. all we are doing is noting whether new damage exists right? Is tenant supposed to sign the form at move out or do I just giver her a copy? I imagine she won't want to sign anything thinking that that will make her liable...which she is but that's neither here nor there....

T will never agree to sign the form if it shows damage beyond normal wear and tear. T should be completely out premises and have surrendered the keys thus relinquishing any right to return to the premises before the final inspection occurs.

There is no need for the T to be present or to sign the move out report.

We state in our lease that a walk-through will be performed within 3 days of move-out. We take pictures in the initial walk-through, and note anything needing attention. We both sign off on it. At moveout, we take pictures again, really don't need to discuss anything with them, just be pleasant and get the keys and their forwarding address, there is nothing for them to sign off on; you have a few days to assess the unit and in our state, 30 days to get their deposit back to them. We tell them ahead of time what they need to do in order to get their deposit back, in a form letter, via e-mail. They have to report any leaks or broken or damaged items to us via e-mail, we tell them that texts and phone calls will not suffice, in the last month of occupancy. Most tenants will follow instructions if they want their deposit back. We have 30 days to get it back to them and typically send back their deposit well within the 30 days.
