Meh...I could go either way on this. If the language is clear tHen he should honor it and pay but if not absolutely clear, I'd drop it. The dog pee and back yard will have to come out of the reg deposit. Might be better to let it go than start a fight....

I felt they had been good tenants up to this time I would keep the money that had been given and let it go and make sure I checked carefully for damage that may have been done by that dog when they leave.

It is stated in the contract the his daughter signed that even if they got rid of the dog from the time the contract was signed that they still owe me the rest of the deposit. Unfortunately when I rented the place to them I broke the cardinal rule about renting to friends. I have only gotten the regular deposit from them and I have never gotten any extra deposit money from them for all the cats that have been in and out of the rental. At one point there had to be at least 5 cats in the house and because they are not even remotely clean people, as I have come to learn, all of the carpets and other floor coverings will have to be replaced when they move out. I just hope I don't have to replace sub-flooring as well. So I am just trying to recoup some of the losses that I will incur when they do finally move. There is way more to this story but I would just be venting and I don't want to burden you all. Oh, by the way, they have been living there for 10 years.

    If they have been living there for ten years, you would've had to replace all the carpeting, etc. anyways. It's useful life is less than 10 years in a lot of cases. It's around 10 years for most residential carpeting, unless you got the really fancy stuff. So you can't charge them for that, that's normal wear and tear over a 10 year period. As will a lot of things be considered normal wear and tear over a 10 year period.

      I know I can't charge them for the carpet and I know it is a wear an tear item that has a life span. But all the cats that have been through that house over the years (maybe 25-30, no I'm not joking), along with the dog, have pissed and crapped all over it and the stink is terrible. I am going to have to spend several hundred on Kills paint to block the stains from coming back up and to seal the stink in. That is if the sub-floor is still in good enough shape. I replied to one of you other post too..
