My lease agreement is with a tenant that had a minor child, who is now an adult. Do I serve both the tenant and adult child on the same unlawful detainer form even though the lease agreement is with the tenant only?

address it tenant's name (who signed lease) "and all others in possession of the premises located at....."

Serve to "Tenant Name Et Al" that covers anybody you may not know about also.

You can name both if you have the name of the adult child as it appears on an I.D. and not a variant of it. But you may name the tenant with the additional wording of "and all others." But naming both tenants will make sure the eviction gets on both credit records.

In the eviction declaration you will want to name the lease/agreement holder, her son's name and the terms; any subtenant, or any and all unauthorized occupants.

In the future, get the name and social security number of every person living in the house. This includes minor children. Even babies have a social security numbers at a minimum. Older children 16 or more will most likely have a state I.D. with a photo. There is no such thing as an adult child. A person is either an adult or a minor. An adult that is soaking up free rent is a squatter and needs to be named in the eviction. It does not matter how old they are or how they became a squatter. It certainly should not matter to the landlord how is not getting paid and has to figure out how to make the mortgage payment.

Any time you know the names of tenants or occupants, you should always name them on the eviction suit, and include "and all occupants", "et al.", or whatever your jurisdiction typically uses to include all hangers-on and unidentified potential occupants.
