Rented studio to tenant now mother has moved in by cassandra (new york) on July 16, 2012 @08:07

                              
had new tenant sign lease as single occupant in my studio apartment and now she say her mother will be staying for 30 days. Her mother is looking for an apartment so she says. I know if someone stays anywhere they have squatter's rights is there anything i can do to protect my self in this situation.

Kick her out? Seems pretty simple. If you're not that cold hearted, have her sign a one month lease and immediately non-renew it. These situations RARELY end well.

No, she will not have squatter's rights. She will establish a tenancy at sufferance. Squatting is an adversarial process to gain ownership of a property.

Will this exceed any occupancy limits?

Nothing is so permanent as the temporary. This woman is coming to stay. You should also realize that all single tenants will bring in additional occupants. Denying permission for the guest is complicated if it is family. What you will eventually end up doing is terminating the lease if it is month to month or evicting both of them. Believe me. The mother will not be moving out.

Giver her notice to cure or quit?? That is what I would do. She has violated the terms of the agreement.

A tenant is allowed to have guest, what would limit the stay, is determined by what's in the lease. Do you have a clause that limits the time a guest may stay?

My lease states 7 days for guests and breach at owners option and rent will be increased by $500 a month.
