Is this tenant under a current lease or is he now M2M -- meaning do you re-sign a lease annually or just let it roll along? If he is M2M, you need only provide him with a 30-day notice of change of terms (check your state law for the correct period) and then the new terms go into effect on the 31st day after the notice is provided, assuming the tenant doesn't object by giving you his notice to terminate the rental and actually moves out. He does not need to affirmatively agree to the terms; his remaining in the rental after notification indicates his acquiesence to the new terms. Meanwhile, my previous answer stands -- this person is causing a health hazard in your rental property and may be affecting neighboring units.
