My tenants are moving out in a few weeks after living there for 2 years. I have questions about whether to charge for crack line inside the sink. It's a nice sink that probably cost about $200, and it was installed in 2003. When I asked the tenants (3 single guys) what happened, they said they didn't know and didn't do it. How would you approach this? should I deduct? if so, how much?

Sinks do not crack on their own. If the crack wasn't there when they moved in, they owe for the damage.

Did you go through the place with them before they moved in and list any known problems? If not then most likely a judge would throw out your claim if they took you to court. If you did and the cracked sink wasn't listed then charge them for it.

A cracked porcelain sink installed in 2003 is not normal wear and tear. Your tenants should be on the hook for repair or replacement. You still would have to charge them depreciated value for the permanent fixture.

Not certain what the debate is about …
The Property Inspection Report would indicate the condition of the premises at move-in. The damage to the porcelain sink was not mentioned by the tenants at move-in, nor was the damage to the porcelain sink report by the tenants to the landlord at time of occurrence. Therefore, the tenants are responsible for any damage beyond normal wear and tear, not included in the property inspection report, and not reported by the tenants.

Are you all serious ! Calf is earthquake land. I have seen a few cracked sinks and tubs. Not the tenants fault. In any case you are talking about a sink that is 9 years old. A judge would not allow you to charge for this. Be happy you got 9 years service for a $ 200.00 sink.

No matter what caused it the tenants did not report it. I would think if it was from an earthquake they would call and say gee your sink cracked from the earthquake. I would charge them the cost to repair it. If you replace it you cannot charge them the entire cost because of depreciation. I have a porcelain sink that is 40 yrs old with no cracks and I live in WA state and we have had a few earthquakes as well. I think it is silly to blame it on an earthquake if the rest of the house had no damage.
