How to evict

We raised the rent for the first time in three years. (3%). Everyone was fine except for one tenant who has become a huge pain in the butt. Gives us lists of things to fix, then complains my husband is spending too much time at the apartment. Gives us two seperate checks - one for the original rent and one for the increase with snide comments. Nothing criminal or anything, just getting 10 text messages a day from her is getting old. I thought she'd grow up after a month, but it's been 2 1/2 already. Can I raise her rent again? Give her listings to other apartments? How do I get rid of her! Help! Thanks in advance.

What state? Is she m2m or fixed term lease? For most states, if it's m2m then just give a 30 day notice to vacate.

You get rid of a tenant by failing to renew the current lease or by terminating. If you tenant is a month to month tenant you need only to send a 30 day notice by certified mail. If your tenant is not gone at the end of that time you need to file for and eviction.

In order for the tenant to claim a retaliatory eviction, the tenant must have filed a formal complaint related to the premises with a government agency or division in authority. Some tenants are immature and the only real solution is to suggest a mutual agreement for lease termination with a specific move-out date, or to initiate the eviction process. The nuisance tenant will either realize the imposition to the remaining tenants who may also have to move, and begin to weigh the time and costs of finding a new apartment rental and moving expenses. (Possibly the nuisance tenant may calm down and behave professionally when faced with the alternative.)

In California, if the tenant has been there more than 12 months you have to give 60 day notice not 30.
