I don't plan for my lease to go to court; maybe you should screen your tenants better (love it when posters give that snappy little piece of advice).

Whether the landlord is sued, or whether the lease agreement is viewed by the court, is generally not dependent upon the landlord. The tenant may dispute the lease agreement which will require scrutiny by a court or legal department. The tenant may file a property complaint with a government agency or department which will require scrutiny by a court or legal department.
