on a tenant who is month to month , does there need to be a specific reason to evict tenant or can it be because she is a pain: example , when i was interviewing a prospective tenant she blast her stereo in order to make it seem its a loud building . constantly complains , all of this stemming from a 3% rent increase 1st increase in 5 years .

You can give 30 day notice to leave or you can give them a 7 day notice to cure, then if he does change his ways you file the eviction for non compliance of the lease and violating the noise clause.

You are confusing the terms : eviction and notice to move.

You cannot evict without a cause AND a court order.

You can notify the tenant to move. If the tenant is month-to-month, then you just send to them a written notice that you are terminating theie tenancy...you do not have to give a reason.

You can evict provided you give the tenant written notice to fix whatever part of the lease they are violating and give them the propery time to get it done. Only if the tenant fails to fix the problem within the time can you then go to court and file the papers to evict. This then will go to a judge to decide.

I think you are just taking about telling the tenant to move out... give them the proper notice.
