what are my rights if someone has a person living in the duplex and is not on the lease?

Depends on your lease agreement. Unless clearly defined visitor policy, there is nothing you can do. Illegal tenants are often in the mind of the landlord. Tenants are federally allowed up to 2 occupants to room and one in LR.
Lots of landlords do not get this and lots of others make up rules about who can live there. I do not know if many of those attempts would hold up under court. That seems like a landlord who comes in to a store and starts telling a retail tenant what he can/can not stock on his shelves.

First call the tenant and tell him the squatter is not allowed. Then post a cure or quit notice on the door followed by another by certified mail. If the tenant does not move the squatter out within the limits of the C/Q notice you need to file for eviction.

The definition of an unauthorized tenant is limited to unrelated parties to the lessee in lease agreement. The immediate relatives of the authorized tenant are legally allowed to dwell at the premises, provided they meet the landlords lawful requirements of no criminal background, etc. If the authorized tenant gets married during the tenancy, the spouse is legally allowed to dwell at the premises, despite being unemployed, or having poor credit, or not meeting other rental move-in requirements. If the authorized tenant has dependent children, the dependent children are allowed to dwell at the premises.

This depends on the lease. Do you use a lease that lists all adults to be living in the unit? I ask my future tenants to list all adults, and occupants(usually the children) as well. An occupant in my state covers anyone that stays over more than three nights. Just tell your potential tenant that if grandma comes from Florida, a preapproved guest can stay one week. Your rights are to know who is living in the unit, and the right to march them down to the local police dept for their criminal report if they have stayed more than three nights......at least in my state. Does the illiegal occcupant receive mail at the address? Are they willing to supply a criminal report? Do they contribute to the rent or utilities? A lot of the younger women do not understand the trouble a supposed boyfriend can cause them.....like losing their rental.

I had t, a self employed Contractor, nice new truck, passed all my criteria. A month in, he disappeared and a prostitute moved in. After hearing no word back from my original T, and after confronting the prostitute, who refused to leave, (i was getting many complaints from other tenants about noise,traffic all hours,etc). She refused to give me her name. So the next time she went out, I changed the locks a put a notice on her door to call me. Never heard from her again, and after a month went in and tossed her stuff. She had little personal stuff, but I found used needles and crack pipes all over.
