Nothing is mentioned about the driveway though tenant is responsible for maintaining the yard,cutting grass ,shrub trimming, etc. But my point is since she is the living in my house , it is her job to maintain the exterior part of the house. I can assume responsibility for re-painting the house and fence but not the driveway.

    If the HOA is going to fine you for the spot on the drive you need to have it cleaned. You can deduct the cost from the deposit when you send out the settlement statement at the end of the tenancy. Then, mention this in your future lease.

      You cannot just randomly save up expenses to attach to the SD at the end of the lease. In most cases, if you have made no timely effort to enforce a provision of the lease such as tenant's financial responsibility for maintenance/repair, you have lost the opportunity to do so at all. This means you must send an invoice and demand for payment to the tenant before you can squirrel this charge away to blast them with it on the SD.

I am in Daytona. This sort of maintenance I would consider as part of the house maintenance that the tenant does to maintain your property. If he is not going to cure the problem in a timely manner so you don't get a fine, then i would go over there and do the cleanup and then send him the bill. When he pays the rent i would deduct the bill and give him a receipt showing the rent is not paid in full. If he doesn't pay up within 3 to 7 days then give him a 3 day notice and tell him I would hate to have to evict you. You really need to decide if you want to go this far or just eat the cost. Though sometimes that starts other things from not being taken care of. Good Luck
