Does Anyone Really Still Use a Newspaper? by Franklin (TN) on July 24, 2012 @08:52

Seriously? Who still uses a newspaper to "prove" what day a notice was posted or picture was taken? This is the most idiotic thing I've ever heard. No one wants to post-date a picture (take it today and make people think it was taken August 1). People DO want to pre-date pictures (take a picture today and make it look like it was taken last week). What's stopping me from using the July 1 newspaper, taking a picture today, and claiming I posted the notice on July 1? Nothing... that's why this whole newspaper business would never hold up in court. There's just no way to prove based on a newspaper that a picture was actually taken on a certain date.

And forget about camera timestamps. Those can be tampered with very easily. I can make my phone or camera take a picture in 1995 or 2020 according to its timestamp.

Postmarking is the way to go. Certified mail is proof of notice attempts.

All kinds of things are subject to being faked or forged yet they are used in court every day.

Can't mess with a time stamp on IPAD or I don't think!

I've been saying this for years! I have never ever had a court ask for proof of posting other than the green card which shows the date mailed (although I believe one or 2 states require a witness). The 5-day count here begins at the time of mailing, although contemporaneous posting is required. If a court is going to take your word you didn't pick a newspaper from a few days before to photograph, they'll just take your word that you posted it without the meaningless newspaper photograph.

The only thing the newspaper shows is that the photos are not from before the trashy tenant moved in. Sometimes they do try to claim in court that your photos are before photos and that they had to clean all that up on move-in.
