Follow up to earlier post re: notice to not renew by Matsui (NYC, NY) on July 24, 2012 @20:58

                              
Thanks to the many who answered my earlier post today, especially Franklin (TN) and John-PA-LL with their follow ups.

I met with my tenant today, and he has agreed to vacate by late September, so my new tenant can take occupancy on Oct 1st. My questions are as follows:

Should I put something in writing for tenant's signature to cover the month of August and the partial month in September that he will stay on after the July 31 expiration? Rent is the same as under the expiring lease. Or will his tender of a rent check and my acceptance of the same on August 1 and Sept 1 be enough to create the month to month tenancy?

My understanding is that 30 days written notice is required in NYC to end a month to month tenancy. Is this a Notice to Terminate or Notice to Vacate? I'd like to put in writing the date we agreed upon for him to move out by.

put it all in writing and send letter certified.
