I started eviction action against my tenants in April due to non payment of rent. They got legal aid and were ready to take their chances in a trial. I decided to settle with them and as part of the settlement, they don't owe me any money and can stay till Jul 31. In case they need more time to find housing, they can pay me a fixed amount every week till Aug 31 maximum.

Last week, they called me to inform me that the shower faucet was leaking water and some was dripping downstairs into the dining room. Turned out the shower valve gave away and water leaked behind the shower wall to the ceiling below.

I got the faucet fixed and repair work in the dining room is in progress. Tenants have all facilities in the house working except access to the dining room and living room. The affected area will be sealed off on Monday when they remove part of the drywall and ceiling since there is asbestos coating.

Do they have enough cause to try and change the settlement to not pay for Aug either? From my knowledge of the law, the unit is technically habitable.

You're fine. You're sealing it off to repair it nd repaiirng it right away. No sweat....

I am just wondering how your "settlement" was better than an eviction. What will you do when there are still there on September 1? Meanwhile you are furnishing them with months of free rent.
