i m the landlord and advised my realtor to withold the security deposit due to breach of contract from the tenant. the tenant is unlikely going to sue me in the small claims court as my counterclaim would be much larger. now, the realtor is refusing to release the security deposit to me and he assured me that he will not release it even after the one year statute of limitations has lapsed. what can i do?

It sounds to me like you are going to file in small claims against your property manager. (I would start by firing them too)
