Still there after eviction date

Well the 30 day eviction notice has run out and I filed papers today with the court. I went to collect back rent that tenant said he had (this is not the only reason I gave him an eviction notice)and he told me he spent it on food because I told him I did not want it. You have got to be kidding - I am not in this business to not collect rent. So now he is behind on rent and living there for free till we get to court-probably another 2 weeks and then who knows. This is an unreasonable young man who has a pretty bad temper. Should I continue to try to collect weekly or just wait till after he is out and bring him to small claims court?

Wait it out until he is out and file in small claims court. He's not going to give you money next week either. His non-payment will strengthen your case that much more.

Don't take any more money from this guy.....partial payment may void out your eviction proceeding. Your goal now is to get this guy out of there as soon as possible so you can screen very well for your next tenant,

I agree. Dont take another time from this guy. If he is unreasonable, has a bad temper, doesnt pay rent, WHY would you want him to stay ? Evict him and find a good tenant.

Do NOT accept a nickel or you're hosed (been there, done that), unless it is the full amount of everything he owes. Keep pushing thru the eviction process and get him out. Hopefully he's not one of those guys that knows how to work the system and you can get him out soon. Once out take him to court and get a judgement against him. It will be too late to prevent him from screwing his next LL, but it will be on his record for the time after that.
