I recently posted a topic regarding issues I have been having with terrible tenants I have at a 3 unit building in Chicago that my wife and I own.

Their lease ends 7/31 and it looks looks they finally will be moving out on 08/01. They only let me know of this yesterday and there is no way for me to be there for the checkout as I currently leave out of state and have to work.

Is it okay for me not to be there when they leave? I might be able to be there next weekend to check out the place and start getting it ready for the new tenants.

It is likely I will need to use at least a portion of their security deposit to repair some of the damage they have done to the unit. Unfortunately I did not give them a form when they moved in to describe the condition of the apartment.

Any advice handling this checkout procedure will be greatly appreciated.

It is okay for you not to be there when they leave but you should really have someone there to get the keys and issue a receipt for the handing over of the keys. Another option would be to instruct the tenant to leave the keys on the counter and lock the door behind them. I would then advise you to go to the apartment and change the locks ASAP.

The walk through can be done when you have the time however, make sure you leave plenty of time for yourself to assess, repair and send out the settlement letter/sd back to the tenant within the timeframe dictated by your state's law.

The tenants did not provide the requisite thirty (30) day notice of intent to vacate. This make the tenant liable for the monthly rent from August 1, 2012 through September 1, 2012. The State of Illinois requires the landlord to issue the security deposit settlement statement within thirty (30) days of move-out. The landlord should request that the tenants provide a forwarding mailing address and to return the keys via certified mail to confirm delivery. The landlord should further instruct the tenants to provided a dated notice of intent to vacate to confirm move-out, and to disconnect the utility services held in their names.
