I am in nevada and at the end of this month the contract finish with the tenant. He asked me if wecan do month to onth until he found another place, I Said no problem just he has to give me 30 days notice , so he give me today 30 daysnotice so he should to pay 15 days for the september month, I would like to ask him to pay the 15 days of september now, just i want to make sure he will pay september, i am in the right to ask this or how can i handle it?

To me M2M means from the first to the last day of the month. A 30 day notice to vacate provided on any day after the first does not have a start date until the first of the next M2M rental period. Provide the notice on the 29th then the 30 days starts on the first of the coming up month. Provide notice on the 14th of August, the 30 days do not start until the 1st of September which means you are owed rent for the entire month of Sept. on Sept. 1. If you choose to make a deal that a notice provided on the 14th means the 30 days starts tomorrow, then you haven't fully explained to your tenant what a M2M rental period is. The problem comes when the tenant hasn't left on the 15th of the next month and stays longer, you have let them live there rent free and you seem like a pushover for not enforcing rent due and then realize you should have served them with a pay or quit weeks ago. Take the entire month's rent which you are due and refund tenant a pro-rated amount for the days after he actually left.

You can ask but if your state is a literal one(if it's not you can bargain with the extra 15 days he'll have to pay if he doesn't pay now) But since his rent isn't due till the 1st he can just tell you no.

My rental agreement calls for a 30-day PAID notice, which means the tenant is required to tender the payment for the remaining 30-day period at the same time he gives me the notice. So if you got notice on Aug. 15, it should have been accompanied by the payment of the additional 14 days rent which takes teh tenant through the 30-day notice period ending Sept. 14. Check the language of your rental agreement.
