So, the tenant I am trying to evict sent me a certified letter. She was notifying me of the repairs that need to be made. (2) repairs I was aware of, a leaky faucet (which I am responsible for, already purchased and dropped off to her for the repairman (who I cancelled when she refused to pay the rent) and the 2nd is the 20-30 broken ceramic wall tiles in the shower, which is not NORMAL WEAR and TEAR and is her responsibility. The tiles were in cement (not on sheet rock) and that many tiles don't just fall off the wall and shatter in one shot. The other items she is claiming is a leaking bathroom sink, toilet and radiator. Immediately before she moved in 2 1/2 years ago all of the plumbing to both the bathroom and kitchen had been replaced.

So my question, should I ask my plumber to go there and inspect the home (not repair, just inspect). Notify her of date and time the plumber will be there. My feeling is that she will not allow him access to do the inspection. And if she does, I will at least have some record from him what the issues are and possibly how they were caused.

Any thoughts on this? good idea, bad idea

Canceling the plumber to replace the faucet is just shooting yourself in the foot. Potential water bill increases and water damage. Also, looks bad to the judge.

If a tenant says leaking water YOU need to inspect immediately. Even if they caused the damage you need to prevent further water damage from occurring. This would fall under an emergency, not even absolutely requiring 24 hour notice to enter. If you feel you need to give 24 hours notice, do so. But go yourself with the key, with plumber if you wish, and inspect the property. Take remedial action (and pictures) to remedy any issues ASAP.

It will always look better at court if you have responded quickly to these issues.
