Check your state's rental laws. My state, if the guest stays more three nights, she is an occupant. Or so many days during a monthly rental period. Getting mail and staying overnight there shows she is an occupant. An unauthorized occupant is grounds for ending the lease.

The fastest way to get him out is a notice of intention to evict if he is not out. You will need to evict AFTER he is there past the thirty day notice. Stirring him up now is more than likely going to cause him to leave the place a mess. YOu might do best by contacting him, and mail or give him a moveout checklist, reminding him to have the place as clean as it was when he moved in, and that he will receive his security deposit back in the time frame determined by the state's rental law. (In many states, the security deposit return is within thirty days after his exit, and surrender of the keys.....)

My experience is it pays me to play nice, right up to the point a tenant is out, and I get the rental property back in better shape. This is true even when I have had to give a tenant notice to leave.
