So I am the unfortunate landlord to have the displeasure of working with a terrible property management company who is managing the eviction process of my tenant.

The Tenant has not paid rent for the past 3 months and eviction papers were filed, went to court and got judgement in our favor on March 21. However the Tenant has already moved out, and I don't have my rental property in my possession as my property manager informs me that they cannot do until the sheriff or the eviction people go to the house and put a lock box on it.

I want to have the property in my possession as soon as possible and looks like the sheriff or whoever does evicts is taking their sweet time. It's been almost 25 days since the court date.

How long does it take for sheriff to go to the house and do what they need to do so that I can have the possession of my property??

Did the tenant surrender the keys? If so then it is vacant and in your possession. Is all of their stuff gone. Did they tell you they moved out? You management company sounds like a bunch of morons...

Your PM should be visiting the property NOW to secure it and to view the inside for damage since it was left open. See if the tenant's left the keys on the kitchen counter or elsewhere inside the rental. Also, look for any personal items such as toothbrush which might indicate tenant is still living there. If they left keys or took all personal items (not including trash or valueless personal property such as broken furniture, etc.), there's no reason to wait to take possession. Some states allow the LL to take possession at any point after the judgment so long as the tenant is not present in the unit, by changing the locks. The Sheriff is only necessary to keep the peace if the tenant has to be physically ousted from the rental.

Time to take control of your own property.
Read over your property management. You should be able to cancel it.

Contact the sheriff and cancel the eviction since the tenants are out. You are entitled to a refund.
The management co. is wasting your money and ripping you off.

Get rid of the bad manager.
