I have this tenants that both sign the contract. now the girl left whit her daughter and im not sure if he will stay jet. the girls is asking me for the deposit because she said it was her money and that what happen is that he trhough her and her daughter out of the house because he got another girlfriend, so of course she anted the deposit back. so what shall I tell her?

The deposit money always stays with the LL until everybody who signed the original lease is out. Then, any money left over after taking out for any damages and unpaid rent is sent to the last T out. If damages exceed the deposit, you need to file a money judgement against both former tenants. You will need to start eviction procedures against both the original tenants,( and the new person if you have their name )for bringing in a person without your permission. Or, if they are on M-T-M tenancy , you could give them a 30 day notice to be out by May 31. You cannot sign a new lease with the new "couple" because the T who left is still a party to the lease. Do not get in the middle of the 2 tenants that split, or the 3rd one who recently came on board. They will have to work out their problems among themselves. Good Luck

If is not your job to referee the crappy the way that people live these days.
What do you tell the ex-girlfriend, like G said, that she is still on the lease and the last tenant out will get the deposit or not. It will depend on the repairs, damages and cleaning that needs to be done plus any back rent. So, she may end up with a bill and a court date instead of a refund. But take a good address from here because when you ask for damages or need to evict the lot of them, she can be named in the action. Contracts exist for a reason. They are more than a pinky swear.

Why do an addendum? Start a new lease. Go through the process of inspecting the place, take the pre-movein pictures, credit check, background check, update the employment information,etc.
As for the security deposit back, it goes back to both parties that signed the existing lease. And a new security deposit is collected, as well as any planned increase in the monthly rental amount. If there are any damages, only the portion of the security deposit that is due goes back.
