The deposit money always stays with the LL until everybody who signed the original lease is out. Then, any money left over after taking out for any damages and unpaid rent is sent to the last T out. If damages exceed the deposit, you need to file a money judgement against both former tenants. You will need to start eviction procedures against both the original tenants,( and the new person if you have their name )for bringing in a person without your permission. Or, if they are on M-T-M tenancy , you could give them a 30 day notice to be out by May 31. You cannot sign a new lease with the new "couple" because the T who left is still a party to the lease. Do not get in the middle of the 2 tenants that split, or the 3rd one who recently came on board. They will have to work out their problems among themselves. Good Luck
