evict ex girlfriend from house we share that I own - Landlord Forum thread 317748

evict ex girlfriend from house we share that I own by willie (ohio) on April 21, 2014 @12:41

I am trying to evict my ex girlfriend. She assaulted me the other day and is impossible to live with. The court was no help. They told me where to get the notice to leave premises paper but said I need to seek legal advice. I am not sure how long I need to give her on this notice and what the grounds for eviction would be. I am pretty confused on how I fill out this form. Can someone please tell me what I need to fill into the blanks? " I wish you to leave the following desctibed premises now in your occupation, situated in the ______of__________county of___________and state of ohio, and described as____________together with the lot of land on which said_________is situated. Grounds:________

Ok I think I figured out most of it. What would the grounds be and how long do I give her?

Yours is a familiar story. You did not seek the wisdom of others before entering into this sordid lifestyle and being beat up by your girlfriend. Now you want the courts, police and other landlords to help you referee.

If you need legal advice, go see a lawyer.

At the top of your post, it states " house we share that I own " If you ALONE own the house, and you were BF/GF, and you weren't charging her any rent, or for any utilities, or separating out other household bills, then you do not have a landlord / tenant relationship. That means you can put her out at any time, and don't need a reason, except to say you don't get along with each other. This is no different than when the parents of an adult child have to throw out their child, because they have overstayed their welcome in their parents home. You don't need an eviction court, UNLESS you have a LL/T relationship. Do you have one ??

Willie,

Gonna give you the best advice you have ever had: if the court tells you to seek legal advice, see a lawyer.

There is no lease. I cant just kick her out. I have already talked to the police. I was just asking how long I had to give her and the grounds for eviction.

She assaulted you. Why have you not obtained a restraining order? That will kind of solve your problem right there.

Courts will not give legal advice. They're not trying to give you the brush off. That's standard in every Court in the nation.

If she paid rent, you need to give her the proper notice. Generally 30 days. Check your local laws.

If she never paid rent, she will probably be considered a "domestic partner," in which you it may not be as simple as throwing out a guest. You may actually want to check with an attorney.
