eviction notice fpr untue allegations - Landlord Forum thread 317759

eviction notice fpr untue allegations by Mike on April 21, 2014 @14:56

I have a question i would like to ask regarding my situation. My mother owns a co-op apartment in which I also live in with my younger brother but my mother often is away from the apartment on medical leave because she suffers from mental illness. I am not presently a share holder yet and we received an eviction notice for some allegations from the board of directors which include, drugs, heavy traffic in and out of the apartment and noise pollution past 8pm which are entirely untrue but I have no way to prove it, so my question is now, my mother has to go to court to fight the allegations but she is mentally sick (depression, anxiety and panic disorder) which shes constantly on medication for and I her son and legal proxy would like to represent her in court or rather be present in her stead for she is unable to handle the situation and I would be able to explain things accurately. Would this be possible? Any advice would be appreciative on the matter for I would not want to lose the apartment over such ridiculous accusations that are discriminating against my family thank you for your help and have a wonderful day.

If you have Power of Attorney (is that different from "legal proxy"?) then you have the ability to represent her in all matters, including in Court.

It is not possible for you to lose the apartment because it does not belong to you. You do not pay rent and are a squatter. Your welcome has been worn out by the insane behavior of your mother and the drugs you sell on the premises. The whole lot of you have both feet on a banana peel headed for the door and do not even see it coming. Move out before you are pushed out.

Limited POA is easy to get...my question would be why would you not want an actual attorney to represent you?

Go to legal aid with the eviction paperwork; they should take care of this.
