I was just talking to the magistrate who said that once you get an order for eviction the T has ten days to leave, pay or appeal. If you're just not renewing their lease, what do they have to pay or appeal? It's the end of the lease. Can the T figure out a way to appeal the end of the lease? Why do they need ten days? The lease is over.

In your jurisdiction, an order isn't final for 10 days evidently. It can be appealed within that period or a party can ask for a redetermination or to have the order set aside, within that period. This isn't specific to evictions and it doesn't change for evictions; it's a standard court procedure in all cases.

In your conversation with the magistrate, were you specific that your case was for holdover and not unpaid rent? And is he the magistrate who hears evictions? If not, he may not be current with the law in that area.
